1Introduction
This is a legal agreement between you and PostDICOM B.V. and Ekstrem Bir Bilgisayar Danışmanlık İç ve Dış Ticaret Limited Şirketi (together referred to as "PostDICOM" or "we" in this document), governing your use of the product, software, services, and website (collectively referred to as the "Service"). PostDICOM permits you to store and access medical content — including radiology, nuclear medicine, oncology, gastroenterology, pathology, ECG, and other medical documents and images — and make it accessible on your devices, subject to the terms set forth in this Agreement. By clicking "Agree" or accessing the Service, you agree that these Terms will apply.
2Your Use of the Service
Age Restrictions
To use the Service, you must be 18 years of age or older.
Your Conduct
Don't misuse the Service. You may use the Service only as permitted by law. You are responsible for your conduct and your content stored in the Service, and you must comply with these Terms. We may review your conduct and content in the Service for compliance with these Terms.
You agree that you will NOT use the Service to:
- Upload, download, post, email, transmit, store or otherwise make available any Content that is unlawful, harassing, threatening, harmful, tortious, defamatory, libellous, abusive, violent, obscene, vulgar, invasive of another's privacy, hateful, racially or ethnically offensive, or otherwise objectionable;
- Stalk, harass, threaten or harm another;
- Pretend to be anyone, or any entity, you are not — you may not impersonate or misrepresent yourself as another person, another user, a PostDICOM employee, or a civic or government leader;
- Engage in any copyright infringement or other intellectual property infringement, or disclose any trade secret or confidential information in violation of a confidentiality, employment, or nondisclosure agreement;
- Post, send, transmit or otherwise make available any unsolicited or unauthorised email messages, advertising, promotional materials, junk mail, spam, or chain letters;
- Upload, post, email, transmit, store or otherwise make available any material that contains viruses or any other computer code, files or programs designed to harm, interfere with or limit the normal operation of the Service;
- Interfere with or disrupt the Service (including accessing the Service through any automated means, like scripts or web crawlers), or any servers or networks connected to the Service;
- Plan or engage in any illegal activity; and/or
- Gather and store personal information on any other users of the Service to be used in connection with any of the foregoing prohibited activities.
Your Account
As a registered user of the Service, you must establish an Account. Don't reveal your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account and for all activities that occur on or through your Account, and you agree to immediately notify PostDICOM of any security breach of your Account. Individual users should not share their Account and/or password details with another person. Organisations are responsible for managing access to their Account and ensuring that all users under their Account comply with these Terms.
You agree to provide accurate and complete information when you register with the Service and to keep it accurate and complete. Failure to do so may result in the suspension and/or termination of your Account.
Your Content
The Service allows you to upload, submit, store, and receive content. You retain ownership of any intellectual property rights that you hold in that content. What belongs to you stays yours.
PostDICOM does not control the content posted via the Service, nor does it guarantee the accuracy, integrity, or quality of such content. Your use of the Service and any content is solely at your own risk.
Removal of Content
PostDICOM is not responsible or liable in any way for any content provided by others and has no duty to pre-screen such content. However, PostDICOM reserves the right at all times to determine whether content is appropriate and in compliance with these Terms, and may pre-screen, move, refuse, modify, and/or remove content at any time, without prior notice and in its sole discretion.
Hardware and System Requirements
PostDICOM is a CE-certified medical device. You are responsible for ensuring that the hardware and software you use to access the Service meets the minimum system requirements specified in our documentation. For diagnostic or clinical use, you are responsible for using appropriately calibrated medical-grade display equipment in accordance with applicable regulations and professional standards. PostDICOM cannot be held liable for diagnostic errors resulting from the use of unsuitable or uncalibrated hardware. Individual users storing personal or family medical records for non-diagnostic purposes are not subject to this requirement but should be aware that the Service is not a substitute for professional medical advice.
3Intellectual Property and Account Rights
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers. To submit a copyright infringement notice, please contact us at support@postdicom.com with details of the alleged infringement.
These Terms don't grant you any right, title or interest in the Service, others' content in the Service, trademarks, logos, or other brand features.
You agree that you will not reproduce, copy, duplicate, sell, resell, rent, or trade the Service (or any part thereof) for any purpose.
Unless otherwise required by law, you agree that your Account is non-transferable. For individual accounts, any rights to your account and content within it terminate upon your death; upon receipt of a copy of a death certificate, your Account may be terminated and all content within your Account deleted. For organisation accounts, account rights and content ownership remain with the organisation and are governed by that organisation's own succession or transfer arrangements.
4Acceptable Use
These Terms constitute PostDICOM's acceptable use policy. We may review content to determine whether it is illegal or violates these Terms, and we may remove or refuse to display content that we reasonably believe violates these Terms or the law.
5Modifying and Terminating the Service
Changes to the Service
We are constantly changing and improving the Service. We may make performance or security improvements, change functionalities or features, or make changes to comply with law or to prevent illegal activities on, or abuse of, our systems. We will provide notice of material changes to the Service that we reasonably believe will adversely impact your use of the Service.
Suspension and Termination
You can stop using the Service at any time. You may cancel your subscription at any time directly from within your PostDICOM account. You do not need to contact support or provide a reason for cancellation.
We may suspend or permanently disable your access to the Service if you materially or repeatedly violate these Terms. We will give you prior notice of suspension or disabling except where you are using the Service in a manner that could cause us legal liability or disrupt other users.
We reserve the right to suspend or terminate your access to the Service with notice if:
- You're in breach of these Terms;
- You're using the Service in a manner that would cause a real risk of harm or loss to us or other users; or
- You don't have a Paid Account and haven't accessed the Service for 12 consecutive months.
We won't provide notice before termination where:
- You're in material breach of these Terms;
- Doing so would cause us legal liability or compromise our ability to provide the Service to other users; or
- We're prohibited from doing so by law.
Where a free account is terminated due to inactivity, all data associated with your account — including stored medical images and files, database records, and shared links — will be permanently deleted at the time of termination and cannot be recovered.
Discontinuation of the Service
If we decide to discontinue the Service, we will give you at least 60 days' prior notice. During this notice period, you will have the opportunity to export your files from the Service. We believe that you own your files and preserving your access to such files is important. After the notice period expires, all data remaining in your account will be permanently deleted.
6Data, Privacy and Patient Content
Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of your data as described therein.
Where applicable data protection law grants you rights in relation to your personal data — including the right to access, rectify, erase, restrict processing, object to processing, or receive a copy of your data — the full details of how to exercise those rights are set out in our Privacy Policy.
Patient and Medical Data
The Service may be used by healthcare professionals and organisations to store and manage patient medical data, and by individuals to store their own or their relatives' medical records. By uploading any medical data to the Service, you represent and warrant that you have the legal right to do so — whether as the data subject, an authorised healthcare professional, or a person with a legal basis to process that data on behalf of another individual. PostDICOM is not responsible for content uploaded without proper authorisation or in violation of applicable data protection, medical, or privacy laws.
Third-Party Services
PostDICOM relies on third-party providers to deliver the Service, including Microsoft Azure for cloud infrastructure and Stripe for payment processing. These providers operate under their own terms and privacy policies. PostDICOM is not liable for any failure, outage, or data loss caused by a third-party provider. By using the Service, you acknowledge that these third-party terms may also apply to your use.
Data Breach Notification
In the event of a personal data breach affecting your account, PostDICOM will notify you in accordance with applicable law, including GDPR where relevant.
Data Portability
You have the right to export your data from the Service at any time. We recommend exporting your data before cancelling your account, as all data is permanently deleted upon cancellation and cannot be recovered. Data export is only available while your account has an active paid subscription. PostDICOM is not obligated to retain or provide access to your data after your subscription has ended. No Backup
PostDICOM does not maintain independent backups of your data. You are solely responsible for maintaining your own copies of any content uploaded to the Service. PostDICOM shall not be liable for any loss of data resulting from accidental deletion, account termination, subscription expiry, or any other cause.
7Subscriptions and Payments
Paid Plans
The Service allows you to subscribe to paid plans. We'll automatically bill you from the date you subscribe or convert to a Paid Account and on each periodic renewal until cancellation.
You're responsible for all applicable taxes, and we'll charge tax when required to do so.
Cancellation
Your Paid Plan will remain in effect until it's cancelled, downgraded, or terminated under these Terms. You may cancel or downgrade your Paid Plan at any time from within your PostDICOM account. Your cancellation or downgrade will apply to the next billing period after the current service term expires.
If you cancel your subscription before the end of the current billing period, you will continue to have full access to all resources and features included in your plan (such as storage, user licences, add-ons, etc.) until the subscription period expires. No refunds or credits will be issued for unused time remaining in the current billing period.
The same applies to any add-ons or additional licences attached to your subscription. If you remove an add-on or additional licence, it will remain active until the end of the current billing period and will not be renewed thereafter. No refunds or credits will be issued for the remaining time on a removed add-on or licence.
Late Payment
If payment is not received within 14 days of the due date, PostDICOM will notify you by email. If payment remains outstanding after a further 14 days, we reserve the right to downgrade your account and permanently delete all associated data, including but not limited to stored medical images and files, database records, shared links, and any other content linked to your account.
Trial to Paid Conversion
At the end of your free trial, your account is automatically converted to a paid subscription and an invoice is created. If the payment for that invoice cannot be collected from your payment method, all data in your account will be permanently deleted, including stored medical images and files, database records, and shared links. The subscription will not be activated. You will be notified by email after this occurs.
Plan Downgrades
If you downgrade to a lower plan, you are responsible for manually reducing your resource usage — including storage, user licences, locations, Medical Device Communicators, and any other add-ons — to within the limits of the new plan before the downgrade takes effect. PostDICOM does not automatically delete data or resources on your behalf when you downgrade. If your usage exceeds the limits of your new plan at the time the downgrade takes effect, PostDICOM reserves the right to suspend access to resources that exceed the new plan's limits until usage is brought within the allowed limits.
Payment Disputes and Chargebacks
If you dispute a charge or initiate a chargeback with your bank or payment provider, PostDICOM reserves the right to suspend your access to the Service pending resolution of the dispute. In cases where a chargeback or dispute is determined to be fraudulent or in violation of these Terms, PostDICOM reserves the right to permanently cancel your subscription and permanently delete all data in your account, including stored medical images and files, database records, and shared links. We encourage you to contact us at support@postdicom.com before initiating a dispute so we can attempt to resolve the issue directly.
Plan and Price Changes
We may change our plans and pricing but will give you at least 30 days' prior notice of a price increase or plan change before you are charged. If you do not wish to continue with the updated plan or price, you may cancel or downgrade your Paid Plan at any time from within your account.
8Our Warranties and Disclaimers
We provide the Service using a reasonable level of skill and care. However, other than as expressly stated, we don't make any commitments about the specific functionality available through the Service, its reliability, availability, or ability to meet your needs.
Service Availability
PostDICOM aims to provide a highly available service but does not guarantee any specific uptime or availability level. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, or circumstances beyond our control. PostDICOM shall not be liable for any loss or damages resulting from service interruptions or downtime.
9Liability for the Service
PostDICOM and its suppliers and distributors are not responsible or liable for:
- Losses that were not caused by our breach of these Terms;
- Any loss or damage that was not, at the time the relevant contract was formed, a reasonably foreseeable consequence of PostDICOM breaching these Terms; or
- Losses relating to any business of yours including lost profits, revenues, or data.
The total liability of PostDICOM, and its suppliers and distributors, for any claims under these Terms, including for any implied warranties, is limited to the amount you paid us to use the Service in the 12 months preceding the claim (or, if the subject of the claim is a free account, to supplying you the Service again).
Indemnification
You agree to indemnify, defend, and hold harmless PostDICOM, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your access to or use of the Service; (ii) your violation of these Terms; (iii) any content you upload, store, or transmit through the Service; or (iv) your violation of any applicable law or the rights of any third party, including patients whose data you upload without proper authorisation.
10API, DICOMweb and FHIR Access
PostDICOM provides API access, DICOMweb-compatible endpoints (including WADO, STOW, and QIDO), and FHIR-compatible interfaces that allow programmatic interaction with the Service. Use of the API, DICOMweb, or FHIR functions is subject to these Terms in addition to any separate API documentation or guidelines provided by PostDICOM.
You agree that you will not use the API, DICOMweb, or FHIR functions to:
- Access data belonging to other users or accounts without authorisation;
- Exceed usage limits or rate limits as defined in PostDICOM's documentation;
- Reverse-engineer, scrape, or replicate the Service or its underlying infrastructure;
- Build competing products or services using PostDICOM's API, DICOMweb, or FHIR interfaces or data;
- Transmit malicious code, automated abuse, or excessive requests that degrade the Service for other users.
You are solely responsible for maintaining the security of your API keys, credentials, and access tokens. You must not share them with unauthorised parties. PostDICOM shall not be liable for any loss or damages resulting from unauthorised use of your credentials.
PostDICOM reserves the right to throttle, suspend, or revoke API, DICOMweb, or FHIR access at any time if usage violates these Terms or places unreasonable load on the Service. PostDICOM shall not be liable for any loss or damages resulting from API, DICOMweb, or FHIR changes, deprecations, or access revocations.
11Laws Governing the Terms
We want to address your concerns without needing a formal legal case. Before filing a claim against PostDICOM, you agree to try to resolve the dispute informally by contacting support@postdicom.com. We will make good-faith efforts to resolve the issue within 30 days.
The laws of Turkey will apply to any disputes arising out of or relating to these Terms or the Service. All claims arising out of or relating to these Terms or the Service will be litigated exclusively in Çankaya, Ankara, Turkey.
12General Provisions
Changes to these Terms
We may modify these Terms to reflect changes to the Service or to the law; in response to guidelines issued by regulators or relevant industry bodies; or to enable PostDICOM to meet its obligations. We'll post notice of modifications on this page. Changes will not apply retroactively and will become effective no sooner than 14 days after they are posted. Changes addressing new features or made for legal reasons will be effective immediately. If an update materially affects your use of the Service or your legal rights, we'll notify you by email at least 14 days before the effective date.
Assignment
PostDICOM may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, or sale of all or substantially all of its assets, without your consent. You may not assign your rights or obligations under these Terms without PostDICOM's prior written consent.
Force Majeure
PostDICOM shall not be liable for any failure or delay in the performance of the Service arising out of or caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or failures of third-party service providers.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and PostDICOM regarding the Service and supersede all prior agreements, representations, and understandings. These Terms do not create any third-party beneficiary rights.
No Waiver
PostDICOM's failure to enforce any provision of these Terms shall not be construed as a waiver of its right to enforce that provision or any other provision in the future.
